304A. Sesiapa yang menyebabkan kematian mana-mana orang, dengan bertindak atau dilakukan terlalu cepat, tanpa mempertimbangkan kesan tindakan atau perbuatan cuai yang tidak terjumlah kepada homisid salah, hendaklah
dihukum dengan pemenjaraan selama tempoh yang boleh sampai dua
tahun atau dengan denda atau dengan kedua-duanya.

304A. Whoever causes the death of any person, by doing any
rash or negligent act not amounting to culpable homicide, shall be
punished with imprisonment for a term which may extend to two
years or with fine or with both.
Further probe ordered on Norikoh case

Kota Kinabalu: The Federal Attorney General has returned the investigation papers on the death of 16-year-old Norikoh Saliwah to the State police for further investigation.
State Police Commissioner Datuk Hamza Taib said the A-G office is personally looking into the case and has directed Sabah police to probe the case further.
"Norikoh's case would be further investigated under the same Section 304A of the Penal Code," he said. Hamza said this when asked on the latest development in Norikoh's case.
A Pakistani man who was held for four days since Wednesday for suspected breach of his work permit will remain detained under immigration law, he said.
Hamza said the suspect has a visa as he had married a local woman but he was suspected to have misused the document when working in a trading premises.
It was earlier reported that the suspect was remanded for 14 days since Nov 28 to be further investigated in connection with Norikoh's death. Her body was found at the roadside of Kg.Ranau in Kota Marudu on Nov 25.
However, the suspect as reported last week has since Dec. 19 been remanded under immigration law. |
